Premises Liability

When any person, such as a customer, tenant or a visitor, is injured as a result of the condition of another's property, the owner of the property may be held legally responsible if their negligence caused the injury. Injuries can occur anywhere such as at a store or other place of business, in an apartment, on a sidewalk or at a home.

These types of accidents are sometimes referred to as a "slip-and-fall" or "trip-and-fall" accidents, but obviously the injured person does not have to actually "slip" or "trip" in order to have a viable claim. Anyone injured as a result of another's actions or inaction may be able to recover the costs for medical treatment, for lost earnings and most importantly, for the value of the pain, suffering, emotional distress or disability actually sustained.

In cases involving such injuries, the injured person must show that a dangerous condition existed on the property which was either caused by the property owner or manager, or that the dangerous condition was present for a long enough period of time to allow the responsible party to provide adequate warning of its existence, but did not do so.
